Affiliate Terms

These are the Terms accepted at signup to the Tradelle Affiliate Program. They govern the relationship between Tradelle Ltd (“Tradelle”) and its affiliate partners (“Affiliates”).

1. Brand Protection and Advertising Guidelines

1.1 Trademark and Brand Name Usage

Affiliates are strictly prohibited from bidding on Tradelle’s brand name, trademarks, or any variations thereof in advertising, especially in search engine advertising (e.g., Google Ads, Bing Ads).

The use of Tradelle’s brand name and logotypes in ad copy, display URLs, or landing pages is only allowed as long as impersonation is avoided and Affiliates do not claim to be representatives of Tradelle Ltd. Affiliate practices that can lead to confusion must be pre-approved by Tradelle’s affiliate management team (affiliate@www.mindflowcentral.com).

1.2 Content Guidelines

All promotional content must be accurate, truthful, and not misleading in any way.

2. Ethical Marketing Practices

2.1 Prohibited Tactics

Cookie stuffing or any form of forced cookie-dropping is strictly forbidden.

The use of adware, spyware, or any malicious software to generate affiliate traffic is prohibited.

Creating fake clicks, leads, or sales through automated means or other fraudulent methods is not allowed and will result in immediate termination from the program.

2.2 Traffic Quality

Affiliates must only use legitimate marketing methods to drive high-quality traffic to Tradelle’s services.

The use of incentivized traffic (e.g., paid-to-click, paid-to-sign-up) is not permitted without prior written approval.

2.3 Transparency and Disclosure

Affiliates must clearly disclose their affiliate relationship with Tradelle in all promotional content, including blogs, social media posts, and email marketing.

The use of deceptive marketing practices, including false claims about Tradelle’s products or services, is strictly prohibited.

3. Data Protection and Privacy

3.1 Compliance with Data Protection Laws

Affiliates must comply with all applicable data protection laws, including GDPR and CCPA.

Collection, storage, and use of personal data must be done in accordance with Tradelle’s Privacy Policy and relevant regulations.

3.2 Consent and Opt-in Practices

Affiliates must obtain explicit consent from users before collecting any personal data.

All email marketing must adhere to anti-spam laws and include clear opt-out mechanisms.

4. Intellectual Property Rights

4.1 Use of Tradelle’s Materials

Affiliates may use approved marketing materials provided by Tradelle.

Any modification of Tradelle’s logos, trademarks, or copyrighted content must be pre-approved in writing (affiliate@www.mindflowcentral.com).

4.2 Content Creation

Affiliates creating original content about Tradelle must ensure it is accurate, up-to-date, and aligns with Tradelle’s brand guidelines.

The use of Tradelle’s intellectual property in domain names or social media handles is not permitted without explicit authorization.

5. Commission Structure and Payments

5.1 Affiliate Accounts

One affiliate partner (natural person or juridical person) is allowed to have no more than one affiliate account with Tradelle. 

For accounts with a balance of zero, deletion can be requested (affiliate@www.mindflowcentral.com).

5.2 Commission Model

Standard affiliate partners (Level 1) receive a recurring and/or fixed-reward commission on the revenues generated by clients they refer.

Agency affiliate partners (Level 2) receive a recurring and/or fixed-reward commission on the commissions of their referred standard affiliate partners. Agency affiliate partnerships are not open to the public and cannot be applied for.

An affiliate partner’s personal commission structure can be viewed at https://www.affiliate.tradelle.io/rewards with a logged-in account.

Commissions will only be paid on valid, verified sales that comply with all program rules. 

5.3 Chargebacks, Disputes and Extraordinary Refunds

Depending on their financial institution and payment method, referred clients can challenge payments for up to 180 days after their purchase. Tradelle has no control over it.

Standard affiliate partners (Level 1) bear the chargeback/dispute costs and fees caused by their referred clients when applicable. These fees are determined by the external payment processor, usually amount to 20 USD per chargeback/dispute, are added on top of the initial payment reversal and negatively affect the affiliate account balance.

Rarely, certain situations with referred clients can warrant extraordinary refunds. In these cases, the affiliate commission is reversed and negatively affects the affiliate account balance.

5.4 Account Balance

Since chargebacks, disputes, and extraordinary refunds negatively affect an affiliate account’s balance, it can become negative. There is no obligation for affiliate partners to deposit funds to make up for the negative balance. However, a long-standing negative balance can lead to account suspension. 5.1 still applies.

5.5 Payment Terms

As Tradelle offers its subscribers a seven-day no-questions-asked money-back guarantee, pending commissions will become ready for payout after 8 days.

Payments can be requested via email to affiliate@www.mindflowcentral.com, provided the Affiliate has reached a minimum payout threshold of 100 USD. Exceptions to this rule are possible on request.

Affiliate partners can be paid out via classic bank wire transfer or via PayPal. In the case of PayPal, as this is a business-to-business transaction, the payments are sent via the “goods and services” option, and the recipient covers the PayPal transaction fees, which may differ depending on the recipient’s country.

Tradelle reserves the right to withhold payment in cases of suspected fraud or rule violations pending investigation.

6. Compliance and Enforcement

6.1 Monitoring and Auditing

Tradelle will regularly monitor affiliate activities to ensure compliance with these rules. This especially concerns direct linking to Tradelle’s website through paid search ads.

Affiliates must provide access to their marketing materials and methods upon request for auditing purposes.

6.2 Violations and Penalties

Violations of these rules may result in actions ranging from warnings to immediate termination of the affiliate relationship, depending on the severity and frequency of the violation.

Tradelle reserves the right to withhold commissions and terminate the affiliate relationship for any fraudulent or unethical behavior.

7. Program Changes and Severability Clause

7.1 Rule Updates

Tradelle reserves the right to modify these rules at any time. Changes will be communicated to Affiliates via email and through the affiliate portal.

Continued participation in the program after rule changes constitutes acceptance of the new terms.

7.2 Severability Clause

Should one or more provisions of these Terms be or become invalid or unenforceable, this will not affect the validity of the remaining provisions. The same applies if the Terms do not contain an essential provision. In place of the invalid or unenforceable provision, a valid and enforceable provision will apply that reflects as closely as possible the commercial intention of the parties regarding the invalid, unenforceable, or missing provision.

These Terms of Service constitute a legally binding agreement between the Affiliate and Tradelle Ltd. By taking part in the Affiliate Program, the Affiliate acknowledges that they have read, understood, and agree to be bound by these Terms.
